MSDN recommends using kind="metadata" for captions as a workaround:

I consider that a last resort since it will require users to use differently than it's intended in the spec.

I believe this is now resolved by setting textTracks.mode='hidden'. Move to close.

Agreed - resolved. Tested in Chrome 36.0.1985.143 and Opera 23.0.1522.77

Re-opening this issue. Ghost captions now appear in Safari if there's a default track (see Test 12).
Observed in Safari 8.0.2 in Mac OS X 10.10.1 (Yosemite).

Safari 8.0.2 doesn't seem to support textTracks.mode; if caption track has default attribute it is always displayed by the browser even if mode="hidden" or mode="disabled". The only way I could find to fix this was to remove the default attribute (after assigning it to a variable). Fixed in 9af24d9
