I've pushed a fix (06fd145) for this that incorporates both your suggestions. On touch devices, the submenu toggle will behave as a toggle, which seems to work better with VoiceOver. If it is important for the top-level navigation item to be an active parent link, the active-parent link could be incorporated into the panel content, else or some other mechanism for toggling the menu, like the arrow icons in Multi-Toggle with Active Parent Links but including an accessibility name, would need to be provided. Implementing one of the more complicated responsive design patterns might best be left up to individual implementors.
