I like the simplifications you're proposing in not keeping track of "seen" files and simply dumping everything back into the stream on flush. As for ordering, there are some more concerns similar to what you mentioned -- e.g., what happens when you add a new file that falls under path/to/glob/**.

You may find it more effective to make use of the gulp-order plugin (https://www.npmjs.org/package/gulp-order) to ensure meaningful ordering at all times.
