Sorted but the pwnagotchi into --debug mode and saw this in the log
BT-TETHER: Could not establish nap connection with android-phone
Obvious fix was to check and enable tethering on the phone.. I had checked this previously but that would of been on old 1.5.5 and/or before trying apt-get upgrade

one thing to got me whilst fault finding was the need to reenable BT tethering every time BT was enabled/disabled on the phone.
I'd assumed that setting remained set on the device.
