Since it was built on the clock, you'll likely need to consult the legal department to figure it out.

do you think we can use the same one as node-fuel as well as the same text in the README?

You can release it with no license (which is perfectly valid) until whoever owns the copyright of the source decides what the licensing terms will be. I know you guys spent time writing it, so you'll probably want to consult your legal agreements with HR to see who has copyright over this (and if nothing was specified, it likely falls under 17 U.S. Code ยง 101 and falls to ET, who then needs to make the license choice).

based on all the stuff we had to sign, everything we create is property of SFDC, which I'm fine with. Just want to get it right before releasing it to the public.

The node-fuel one is MIT. I'm not sure who made that decision, because it was before my time, but it seems likely that ExactTarget was never consulted.

The best thing to do is release it with no license for now. That is a perfectly valid way to release software. It means people do not have the right to fork it, distribute it, etc., since no decision has been made yet. They can still use it in their projects and pull it down from npm
, etc.

There's really no way to stop that correct?

Correct. They would simply be violating the licensing terms (which default to U.S. copyright code which basically says you can't without the author's permission). SFDC would have to pursue damages from those people if they were so inclined :)
You can always make a decision, but I certainly wouldn't feel comfortable making one :)

There was a recent issue regarding open sourcing, we will get it through proper channels.

We are working on this. Should have a solid answer in the next day or two.
