SPDX tags should be used near the top of the file, not at the top of the file. See Annex H (emphasis mine):
An SPDX file tag consists of a single line, generally as part of a comment near the top of the file, in the following format:

For elisp files it would be preferable below the Copyright
line (if you follow the auto-insert
format):
