Do you have any specific areas where this happens? The d3d12 one should use pointers only.
as for the inconsistency in other places it might be because a function would not expect a nullptr. Hence you pass a reference (non rebindable non nullable ptr).

It seems to mainly be caused by auto-generated functions when using the Intellisense functionality to create function implementations.
