Yes, you are right. After nginx-1.2.1+ and nginx-1.3.0+, the nginx
upstream round robin module changed greatly.

You should use the patch named 'check_1.2.1+.patch'. Check the lastest
revision:
https://github.com/yaoweibin/nginx_upstream_check_module/blob/master/check_1.2.1%2B.patch

*) Bugfix: nginx might loop infinitely over backends if the
"proxy_next_upstream" directive with the "http_404" parameter was
used and there were backup servers specified in an upstream block.
