I thought, copyright and patent issues were somewhat separate. But in any case, I'm okay with changing the license, which was your original question.

The license has a bad exclusion clause regarding patents. It was a popular choice at the time but I did investigate the patent clause and it actually turns out that this is not really good for anyone. We don't use it anymore (unconditionally) and therefore I see it as a cleanup which gives others more safety in usage

yes, you are absolutely right. CC-BY is only applying to copyright and excludes all possible patent rights. If you read the MPL 2.0 then you can see that patent rights are licensed if it is needed for the program
