general problem with dpkg-divert

Hi,

this seems more like a general problem i have when running build on any of your projects - is it possible you're running an older ubuntu image locally or what could be the reason for this:

Step 2 : RUN dpkg-divert --local --rename --add /sbin/initctl && ln -s /bin/true /sbin/initctl
 ---> Running in b2a11f60d9b2
Leaving 'local diversion of /sbin/initctl to /sbin/initctl.distrib'
: File exists
2014/02/25 11:54:33 build: The command [/bin/sh -c dpkg-divert --local --rename --    add /sbin/initctl && ln -s /bin/true /sbin/initctl] returned a non-zero code: 1
